Terms and Conditions

These Terms govern access to and use of the CarAI mobile application and services (the "App" or the "Service"), operated by:

These Terms govern the relationship between the operator and anyone who downloads, registers for or uses the App ("User"). By creating an account or using the Service, the User confirms having read and accepted these Terms and the Privacy Policy. If you do not agree, please do not use the Service.

To use the App you must be at least 18 years old (or the age of majority in your country) and have the legal capacity to enter into contracts.

3. Description of the Service

CarAI is a tool for car collectors that allows, among other things: organising a portfolio of vehicles and tracking their estimated value; using CarAI Vision to scan a car in person and obtain an instant estimated valuation (freemium); accessing market intelligence; generating PDF dossiers; and consulting the value history. The scope of each feature depends on the plan in use.

4. Registration and user account

Some features require an account. The User agrees to provide accurate information and keep it up to date, as well as to safeguard their credentials. The User is responsible for all activity carried out from their account and must notify us immediately of any unauthorised use.

5. Plans, pricing and subscriptions

CarAI offers the following plans:

Prices are indicative and may include applicable taxes; the final price is set by the app store according to the User's region. Paywall and subscription-status management is handled by RevenueCat; the actual charge is made via Apple App Store or Google Play, subject to their respective terms. Billing, refunds and cancellation are governed by the applicable app store's policies.

6. Renewal, cancellation and withdrawal

Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the renewal date through the account settings of the relevant store. Cancellation stops future renewals; access to paid features continues until the end of the period already paid for.

Under EU consumer law you have a 14-day right of withdrawal. However, for digital content and services, if you request immediate delivery and acknowledge that you thereby lose the right of withdrawal once fully performed, this right may not apply. Refund requests are handled through Apple or Google.

The User may submit content (vehicle data, notes, photos, etc.). The User retains ownership of their content and grants the operator a limited, non-exclusive, worldwide licence to host and process it solely to provide the Service. The User warrants they hold the necessary rights over any content they upload.

CarAI Vision processes images to recognise vehicles and provide indicative estimated values (see clause 10). Unless otherwise indicated and expressly consented to, those images are not used to train models or shared for commercial purposes. Full details are in the Privacy Policy.

9. Intellectual property

The App, its software, brand, logos, design, text and other elements are owned by the operator or its licensors and are protected by intellectual and industrial property law. No rights are granted to the User beyond using the Service in accordance with these Terms.

10. Valuations and market intelligence

The valuations, charts, trends and other market data offered by CarAI are indicative estimates produced from automated sources and models. They do not constitute financial, investment or tax advice, nor an official appraisal, and do not guarantee any purchase or sale price. The User is solely responsible for any decisions they make. We recommend verifying any data with a professional before transacting.

11. Availability and Service changes

The operator aims to keep the Service available and up to date, but does not guarantee uninterrupted operation. Features may be modified, suspended or discontinued, in whole or in part, and new versions may be introduced, with reasonable notice where possible.

12. Disclaimer of warranties

The Service is provided "as is" and "as available". To the extent permitted by law, the operator makes no warranty that the Service is free from errors, secure or suited to the User's specific needs. This clause does not exclude statutory guarantees that cannot be waived under consumer law.

13. Limitation of liability

To the maximum extent permitted by applicable law, the operator shall not be liable for indirect damages, loss of profit, loss of data or harm resulting from decisions taken on the basis of the Service's estimates. Nothing in these Terms limits liability for fraud, gross negligence or any matter that cannot be excluded by law with respect to consumers.

14. Indemnification

The User shall hold the operator harmless against third-party claims arising from use of the Service contrary to these Terms or applicable law, or from infringement of third-party rights through content the User submits.

15. Suspension and termination

The operator may suspend or terminate access for a User who breaches these Terms. The User may stop using the Service and delete their account at any time. Termination does not affect rights and obligations accrued before it takes effect.

16. Data protection

Processing of personal data is governed by the Privacy Policy, in compliance with Regulation (EU) 2016/679 (GDPR) and applicable national data protection law.

17. Amendments to these Terms

The operator may update these Terms to reflect legal, technical or Service changes. Amendments will be published on this page with their effective date and, where substantial, communicated by reasonable means. Continued use of the Service after the effective date constitutes acceptance.

18. Governing law and dispute resolution

These Terms are governed by Spanish law. For consumer Users, the courts of their place of domicile shall have jurisdiction. Pursuant to Regulation (EU) 524/2013, the European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
